 The main difference that came into effect immediately was the added leeway on possession of cannabis in Malta. In April 2015, the authorities decriminalised the possession of up to 3.5g of marijuana for personal use. Since December 2021, however, people can carry up to 7g of cannabis with no repercussions. The fines then come in if someone is in possession of between 7g and 28g. The latter of which amounts is legally deemed to be acceptable for personal use – leading to the same sort of slap on the wrist mentioned earlier. This is compounded by the police not having any reason to suspect that the person is trafficking. 

Another biproduct of this legislation is that people with charges for cannabis possession on their record can apply to have these removed. This measure deserved more publicity considering the near Draconian laws not half a decade ago. It could change a lot of people’s lives for the better. Especially when it comes to cases of people charged for having a dirty bong or grinder.

Smoking in Public

 Although amounts and possession have definitely relaxed, smoking in public is still a big no-no. According to the Authority on the Responsible Use of Cannabis Act (ARUC), any person caught consuming cannabis in public is liable to a fine of €235. And if in the presence of a minor, that will rise to anywhere between €300 and €500.cannabis-law-overview

So what’s taking so long?

Rightly so, thousands of people who had been looking forward to this historic step in Maltese legislation are left asking where we’re at. ARUC has yet to announce the new regulatory framework promised by last April. That being said, the Authority’s Head, Mariella Dimech, has assured the media that there has been progress in terms of meeting all stakeholders. The new deadline is the end of this year, fingers crossed that ARUCs safe use approach pulls through and weed enthusiasts will be able to avoid the black market.

Unfortunately at the moment, since possession laws have relaxed, there is still a heavy dependence on illegal sources for cannabis. Even home growers end up having to get their seeds from unregulated sources.

Where does that leave us?
